MILFORD — Kevin Gonzalez, 17, 309 N. East St., Milford, has been arrested for allegedly raping a victim at a house party in Kosciusko County.

Gonzalez is charged as an adult with rape, a level 3 felony.

At approximately 2:12 p.m. Saturday, Dec. 28, 2024, a deputy with the Kosciusko County Sheriff’s Office arrived at Lutheran Kosciusko Hospital in reference to a sexual assault report. The deputy met with the victim’s father, who stated the victim was supposed to be at the mother’s house over the weekend. Instead, the victim came home early on Saturday, Dec. 28 and was visibly upset.

The victim told her father at that time that after drinking alcohol, the victim went to sleep and woke up with a boy on top of her, identifying the boy as Gonzalez.

According to court documents, the deputy then spoke with the victim. The victim stated they went to a party and got drunk. When they woke up, Gonzalez was performing sexual acts without their consent.

The victim was transferred to the Sexual Assault Treatment Center in Fort Wayne. They were forensically interviewed at Safe Harbor Advocacy Center on Jan. 21, 2025.

The Forensic Interview

The victim stated they went to a house party with a friend and there were around 20 juveniles at the residence. The victim and their friend were drinking alcohol and the friend became intoxicated and left, but the victim stayed.

The victim said Gonzalez was at the party and had been “acting weird” throughout the night, continuously handing the victim alcohol and attempting to do the same with marijuana. Gonzalez put his hands on the victim’s back and waist. At some point, the victim blacked out and did not remember anything until they woke up in the bed upstairs.

The victim stated that later, they remembered waking up in the shower downstairs, undressed, with the water running. Gonzalez was standing in front of the victim as well as another person. The victim said this happened before they woke up in the bed.

When the victim woke up in the bed, they pushed Gonzalez’s hands off and told him either “no” or “stop.” He responded, “my bad,” and the victim pulled on their pants, crawled over Gonzalez and left the room. Gonzalez was the only one to walk down the stairs after the victim did, according to the victim.

Deputy Marshal Interviews

A witness at the party interviewed by a deputy marshal stated Gonzalez was not “acting” drunk, but was being more friendly with others when he is normally quiet. The witness said Gonzalez seemed to be pushing drinks towards others at the party. The witness was taking care of the victim but said they were tired of doing so and Gonzalez helped lay them down.

The witness said at some point, Gonzalez was talking to the victim and told them to take a shower to sober up. Gonzalez led the victim to the shower, helped them undress and get into the shower. Afterwards, the witness and Gonzalez laid the victim down. The witness said before they left, the victim and Gonzalez were on the floor “cuddling.”

The deputy marshal interviewed Gonzalez, who stated he had been drinking alcohol and was smoking marijuana when the victim arrived. Gonzalez said the victim started flirting with him. He said he started flirting with the victim and they hugged a couple times. Gonzalez denied having intercourse with the victim.
