DeKalb County Seeking Judgement For Hotels’ Unpaid Taxes, Fees

AUBURN — DeKalb County is asking for a default judgment in court as it tries to regain funds from two hotels.
A hearing on a motion against Next Generation Hospitality Group LLC, which owns the Baymont Inn and Suites at 306 Touring Drive, is scheduled for Tuesday, July 1.
The county filed a lawsuit with DeKalb Superior Court II, alleging that the hotel group was liable for innkeeper’s taxes, fines and late fees to the county for 14 months.
Kruse said that though some fees have been paid after the suit was filed, the county is still entitled to attorney fees and interest — even if the hotels’ unpaid taxes are fully returned.
Because Baymont has not properly responded to the complaint within the required window, Kruse explained the county has filed for a default judgment.
In a separate case, a similar lawsuit against Performance Hospitality Group LLC has also been filed by the county. Performance Hospitality does business as Country Inn and Suites, 404 Touring Drive, Auburn.
