Warsaw Man Arrested On Drug Charge After Officers Respond To Fatal Overdose

WARSAW — A Warsaw man was arrested on a drug charge after officers responded to a fatal overdose at his residence.
Bret Allen Bailey, 60, 5755 S. East Channel Road, Warsaw, is charged with maintaining a common nuisance, a level 6 felony.
On Jan. 11, police officers and medics responded to a drug overdose at a Warsaw residence. The man who overdosed was pronounced deceased at the scene.
An officer spoke with Bailey, the residence’s owner. Bailey said he heard a woman yelling and went to investigate. He and another person went into a bedroom and found the unresponsive man. They provided CPR and Narcan to the man until medics arrived.
Responding officers saw a smoking device when they first entered the home and later discovered it had disappeared. The woman Bailey heard screaming also left the home with a child before officers arrived.
The NET 43 Drug Task Force had received prior tips about drug use at Bailey’s residence. Officers had previously responded to a drug overdose at Bailey’s home on April 11, 2022.
Officers requested to search Bailey’s residence, and Bailey refused the search. A search warrant for Bailey’s home was granted on Jan. 12.
Upon searching the residence, officers found drug paraphernalia with residue in Bailey’s room and the room where the man overdosed. Drug paraphernalia and residue was also located throughout the residence.
During the search of the residence’s bathroom, the countertop and scale plates in the room were damp. It appeared someone had attempted to clean up.
Bailey has already been arrested and released on bond.
