Warsaw Man Arrested For Using Illegal Drugs In Presence Of Two Children

WARSAW — A Warsaw man was recently arrested for allegedly using illegal drugs while in the presence of two children.
Damian Allen Henry, 38, 212 S. Union St. Apartment A., Warsaw, is charged with possession of methamphetamine and neglect of a dependent, both level 6 felonies; possession of marijuana, a class B misdemeanor; possession of paraphernalia, a class C misdemeanor; and possession of marijuana with a prior conviction, a class A misdemeanor.
On Aug. 11, 2023, a Warsaw Police officer assisted a Department of Child Services worker at a local restaurant. The caseworker said DCS received a report about Henry and two children being homeless and living in a vehicle. According to court documents, there was a concern about drugs being used inside the vehicle.
The caseworker said the two children were able to describe the drug paraphernalia being used in their presence.
Henry gave law enforcement permission to search his vehicle and admitted to using meth a couple days prior. Upon searching the vehicle, officers found drug paraphernalia, marijuana, and meth residue.
The caseworker made arrangements with Fellowship Missions to allow the children to stay in their facility.
Henry has prior convictions for dealing marijuana, maintaining a common nuisance, dealing in a controlled substance, and meth possession. At the time of this incident, he had an active criminal case for marijuana possession.
Henry was booked in the Kosciusko County Jail on Jan. 24, 2024, with a $5,250 surety and cash bond.
