County Health Department Files Suit Against Occupants Of Atwood Property

ATWOOD — The Kosciusko County Health Department has filed a complaint against the owners and residents of an uninhabitable property in Atwood.
The rental property, located at 121 E. Main St., Atwood, is owned by Charlene K. Marshall, Etna Green.
In the suit, the county health department is being represented by Adam D. Turner. Marshall and unknown occupants of the building are listed as defendants.
On Jan. 13, KCHD served an order to vacate to Marshall and the property’s occupants due to a want of repair, which causes the property to be uninhabitable. The complaint, which was filed on March 2 in Kosciusko Circuit Court, states the property is still occupied.
“As a result, the health and safety of the occupants may be at risk due to want of repair of the property,” reads the complaint.
In the case, KCHD is requesting an order from the court to remove occupants from the property, prohibit Marshall from allowing any further occupancy, and require the property be sealed against unauthorized entry.
