WARSAW — An Argos man will serve one year in prison and three years on probation after battering a woman and her children.
Logan Ryan Neidlinger, 26, 322 W. Walnut St., Argos, was charged with two counts of domestic battery with bodily injury to a person under 14, both level 5 felonies; and domestic battery, a class A misdemeanor. Two additional criminal charges were dismissed as part of a plea agreement.
Neidlinger was sentenced in Kosciusko Superior Court One on Monday, Sept. 26.
In December 2020, the Kosciusko County Sheriff’s Office responded to a domestic fight. Neidlinger admitted to pushing one child against a wall and slapping another child in the face after they began screaming. He also admitted to pushing a woman. The two children had marks on the sides of their faces from being hit, and the woman had marks on her neck and arms consistent with being battered.
On each count of domestic battery with bodily injury to a person under 14, Kosciusko Superior Court One Judge Karin McGrath sentenced Neidlinger to one year in the Indiana Department of Correction, and three years probation. He also received one year on probation for the misdemeanor domestic battery charge. All three counts will run concurrently, or at the same time. In total, Neidlinger will serve one year at DoC and three years on probation.
He has 133 days of jail time credit in the case. A no-contact order between Neidlinger and the two children remains in effect, with the no-contact order between Neidlinger and the woman being vacated. Neidlinger is also prohibited from possessing firearms.
At sentencing, Defense Attorney Nikos Nakos said Neidlinger has a pending criminal case in Marshall County. He informed Judge McGrath there was the possibility of Neidlinger being sentenced to home detention or work release in that case.
Deputy Prosecuting Attorney Joseph Sobek objected to any type of alternative sentence for Neidlinger in the Kosciusko County case.
Judge McGrath did not approve for any alternative sentencing, noting Neidlinger’s criminal history and the victims’ ages as aggravators.
“You terrorized and battered two children,” said Judge McGrath. “I hope you understand that this behavior is entirely unacceptable.”
