Warsaw Man Sentenced On Charges Related To 2020 Incident
Staff Report
WARSAW — A Warsaw man will serve time in prison after being sentenced in Kosciusko Superior Court 1 Monday, Oct. 18, on charges related to a violent September 2020 incident.
Brandon Scott Mulldune, 33, 4492 E. CR 600S, Warsaw, pleaded guilty to criminal confinement, a level 4 felony.
Mulldune was initially charged with rape, a level 1 felony; armed robbery and criminal confinement, both level 3 felonies; battery resulting in serious bodily injury, intimidation and criminal organization activity, all level 5 felonies; and pointing a firearm, a level 6 felony.
Judge Karin McGrath sentenced Mulldune to 12 years at the Indiana Department of Corrections, with three years of the sentence suspended and ordered to be served on formal probation.
“You had the ability to change the direction of the events that day and you elected not to do so,” McGrath said.
Mulldune was also sentenced for violating probation in a previous case.
In January 2020, Mulldune was sentenced to prison in a separate matter; however, the sentence was suspended and he was ordered to serve four years on formal probation. Terms of formal probation include not committing additional crimes. Mulldune violated the terms of his probation in September 2020.
Mulldune’s attorney, Jay Rigdon, pointed out that Mulldune had already received a fairly significant sentence for the criminal confinement charge.
In response, McGrath said to Mulldune, “It’s a fairly significant sentence and also fairly significant bad behavior on your part.”
McGrath revoked three years of the suspended sentence. Mulldune will be required to serve that time in prison in addition to the nine-year term. The sentences were ordered to be served consecutively.
Mulldune was given 241 days of jail time credit. Additional charges were dismissed as part of a plea agreement.
A no-contact order is still in place between Mulldune and the two victims.
