Nappanee Woman To Continue Treatment While On Formal Probation In Drug Case
KOSCIUSKO — A Nappanee woman will continue treatment in recovery programs while serving a drug-related sentence on formal probation.
Heidi Renee Graber, 902 E. Lincoln St., Nappanee, was charged with possession of methamphetamine, a level 5 felony; possession of a controlled substance, a class A misdemeanor; possession of paraphernalia, a class C misdemeanor; and failure to appear, a level 6 felony.
On Jan. 25, an officer with the Warsaw Police Department observed a vehicle change lanes without using a turn signal. The officer conducted a traffic stop and used a K-9 unit to complete an outer air search of the vehicle. Graber was a passenger in the vehicle.
According to the affidavit of probable cause, a search of the vehicle led to the discovery of several smoking devices containing residue, a fabric bag containing a plastic bag with a crystal substance, and two digital scales with residue. The crystal substance and residue tested positive for methamphetamine.
While searching Graber, officers found three full pills and three partial pills, identified as hydrocodone, on Graber’s person. After being transported to the jail, officers also found four yellow pills, identified as alprazolam, on Graber’s person.
Prosecuting attorney Dan Hampton told Judge Michael Reed that the pre-sentence investigation report for the case is confusing. Hampton said Graber marked on the report that she does not have any drug-related issues.
Defense attorney Karin McGrath said that Graber has been sober since May 16.
“She has been successful,” said McGrath. “But she’s fully aware of the tightrope you walk on when you’re a recovering addict.”
Graber said that she has been participating in a drug recovery program.
Reed sentenced Graber to four years and 60 days in the Kosciusko County Jail, with the sentence to be served on formal probation. She has 200 days of jail time credit. Reed told Graber to continue participating in a drug recovery program and attend two self-help meetings each week.
“I know this is going to be the hardest thing you’ve ever done,” said Reed. “Good luck.”
