North Webster Woman Sentenced For Maintaining A Common Nuisance
KOSCIUSKO — A North Webster woman was sentenced in Kosciusko Circuit Court Monday, Aug. 13, after officers discovered drug paraphernalia in her vehicle.
Brenda Kay Ball, 105 W. Effie Mae St., North Webster, was charged with maintaining a common nuisance – controlled substances, a level 6 felony; and possession of paraphernalia, a class C misdemeanor.
On Dec. 11, 2017, an officer with the Indiana State Police received information on an intoxicated subject parked at a Circle K gas station. Upon arrival, the officer observed Ball sitting in a vehicle with a male passenger, identified as Justin Lee Lord.
According to the affidavit of probable cause, while speaking with Ball and Lord, the officer observed a cut straw and two mini torches in the vehicle. Also in the vehicle were a smoking pipe, an orange pill identified as the schedule II substance amphetamine, a clear glass smoking device and digital scales.
Defense Attorney Joe Sobek said this is Ball’s first felony conviction.
“This is the largest wake up call she has ever received,” said Sobek. “She realizes that her responsibilities should always be about her children.”
Judge Michael Reed gave Ball a one year and two months suspended sentence to be served on formal probation.
