Brian Phillip Shepherd, 31, 5873 S. East Channel Road, Warsaw, is being charged with possession of a narcotic, a level 6 felony; and possession of marijuana, a class B misdemeanor.
On July 30, an officer with the Kosciusko County Sheriff’s Department received information on a male subject, identified as Brian Roe, with an active arrest warrant from Allen County. The officer arrived and saw Roe standing next to a vehicle with three occupants inside.
According to the affidavit of probable cause, as the officer approached, Roe reached inside the passenger side window where a female, identified as Teresa, was sitting.
The officer arrested Roe and noticed several purses and bags sitting on the floor board of the vehicle next to Teresa. After receiving consent to search the bags, the officer found a plastic bag containing a white powder that tested positive for heroin. The officer also found a plastic bag containing a crystal substance that tested positive for methamphetamine. Officers also found plastic tubes, three straws with residue, a smoking device, and five pills that were identified as Buprenorphine.
Teresa admitted she didn’t have a prescription for Buprenorphine and was using the pills in an attempt to get off of heroin.
At the officer’s request another occupant, identified as Brian, exited the vehicle. During a pat down to make sure Brian had no weapons, officers discovered a bag of green leafy material that tested positive for marijuana. Officers also discovered a plastic bag of white powder that tested positive for heroin.
Both Teresa and Brian Shepherd have already been arrested and released on their own recognizances. They both have an initial hearing date at 8:15 a.m. Thursday, Sept. 20, in Kosciusko Circuit Court.
