Syracuse Man Sentenced On Charges Of Battery, Possession
WARSAW — A Syracuse man was sentenced in Kosciusko Circuit Court Monday, May 14, on charges stemming from two separate incidents.
Jason D. Weisser, 35, 709 W. North St., Syracuse, was found guilty of possession of methamphetamine, a level 6 felony; possession of paraphernalia, a class C misdemeanor; and domestic battery, a level 6 felony.
According to the affidavit of probable cause, officers with the Syracuse Police Department responded to a domestic battery incident Sept. 17, 2017.
When officers arrived, they spoke with the victim, who advised that she and Weisser were arguing in their driveway. The victim stated that Weisser became extremely angry, grabbed her by the throat and threw her to the ground.
The investigating officer observed a large red area around the victim’s neck and chest. The victim also had an abrasion to her left shoulder and redness and scratches on both forearms.
The officer spoke with the victim’s child, who advised she was at the scene and observed Weisser grab her mother by the throat and slam her to the ground.
Officers talked to a neighbor who had witnessed and videotaped the incident. Police viewed the videotape, which showed Weisser grab the victim by the throat and throw her to the ground.
In a separate incident, on Feb. 8, 2018, officers responded to a report of an unwanted person at a Syracuse residence.
According to the affidavit of probable cause, the homeowner said that Weisser, her ex-husband, was at her residence. She stated she did not want him there because she suspected he was dealing drugs.
Officers found Weisser, who would not remove his hands from his pockets. The officers requested that Weisser take his hands out of his pockets.
He removed a plastic bag with a white crystal substance, a glass smoking device and butane torch. The substance tested positive for methamphetamine, weighing 1.7 grams.
Pursuant to the plea agreement, a second charge of domestic battery was dismissed. Regarding the domestic battery offense, Kosciusko Circuit Court Judge Michael Reed said, “I don’t understand that. I don’t know what leads a man to do that, but I guess there’s only one way to make sure that doesn’t happen again and that’s to put you in some kind of structured environment.”
For the domestic battery charge, Reed sentenced Weisser to one and a half years in the Kosciusko County Jail. Weisser was given 54 days of jail time credit. He was ordered to pay a $50 domestic violence fee. A no contact order was issued with regard to the victim.
For the possession of methamphetamine charge, Weisser was sentenced to one year in the Kosciusko County Jail. For the charge of possession of paraphernalia, he was sentenced to 60 days in the Kosciusko County Jail. The sentences for these two charges were ordered to be served concurrently but consecutive to the sentence in the domestic battery case. Weisser was given 96 days of jail time credit. He was ordered to pay court costs and fees.
Reed said he would have no objection to Weisser serving the sentences in Community Corrections or the Kosciusko Work Release Program, provided Weisser is qualified and remains qualified for one of the programs.
