Hamilton Sentenced In Additional Battery Case
WARSAW — A Mentone man was sentenced in a third battery case against the same woman this morning, Aug. 31, in Kosciusko Superior Court I.
Joshua J. Hamilton, 36, 6663 W. CR 500S, Mentone, was sentenced on a single charge of domestic battery, a level 6 felony.
Judge David Cates sentenced Hamilton to 2 1/2 years at the Indiana Department of Corrections, with 1 1/2 years suspended to be served on probation. Judge Cates recommended purposeful incarceration.
According to the affidavit of probable cause filed Jan. 25, on Jan. 12 officers with the Kosciusko County Sheriff’s Department responded to a domestic battery call at Hamilton’s residence.
When officers arrived, Hamilton was standing outside of the residence and advised his girlfriend was inside. Officers spoke with the girlfriend and she advised Hamilton had become angry with her. She stated Hamilton then knocked everything off of the bedroom nightstand and broke a fan before grabbing her by the hair and pushing her head into a door.
Hamilton’s girlfriend advised that she had been holding a child when the incident occurred and that the child’s head hit the door jamb. The officer noted that a red mark was visible on the left side of the child’s face.
Hamilton has previously been convicted in two battery cases within Kosciusko County, both involving his girlfriend.
