WARSAW — Lacy Francis Jr., former Warsaw Street Superintendent pleaded guilty today, June 12, to several charges relating to his involvement in a scheme to intentionally over bill the City of Warsaw for work.

Pursuant to the plea agreement, Francis pleaded guilty to corrupt business influence, a Class C Felony; aiding theft, a class C felony; providing false information to a governmental entity to obtain a contract, a class D felony; and official misconduct, a class D felony.

The plea agreement states the executed sentence must be a minimum of two years. Additional time may be served on work release and probation if Lacy is approved.

Lacy is expected to pay full restitution to the City of Warsaw. The first installation of payment will be taken from Lacy’s retirement fund. He will then owe the city any of the remaining balance. The total restitution amount has yet to be determined.

Lacy’s plea deal acceptance and sentencing is slated for 8:30 a.m. Monday, July 24.

Pro Form, owned by Marc Campbell, schemed with Francis to receive bids on multiple city contracts. After obtaining the contracts, the company intentionally overcharged the City of Warsaw for the work. The Indiana State Board of Account performed an investigation and concluded that Campbell and Francis were both “jointly and severally liable to the city of Warsaw for overpayments in the amount of $318,569.”

Campbell pled guilty in March and was sentenced to serve one year on home detention followed by five years of probation.

Two other accomplices still face charges in regards to the incident. Lacy’s wife, Mildred Francis, faces money laundering charges. She is scheduled for a pretrial conference on June 26. Kevin Brown, a former Pro Form employee, faces five criminal charges. He is scheduled for a pretrial conference on June 26.
