Father, Son Arrested After Elementary Schoolers Caught With Marijuana At School
WARSAW — A father and son were arrested after two Lincoln Elementary students were found with bags of marijuana at school.
Braxton Ryan Hughes, 18, 422 S. Union St., Warsaw, was booked for possession of marijuana and maintaining a common nuisance.
Mark Dale McGillem, 39, 422 S. Union St., Warsaw, was booked for obstruction of justice, maintaining a common nuisance and neglect of a dependent.
On March 17, an officer with the Warsaw Police Department responded to a drug complaint at Lincoln Elementary School. Upon arrival, the officer spoke with the principal who advised two students had been caught with marijuana.
The two minor students came to school smelling like marijuana. After a teacher questioned one of the students about the smell, the student provided a plastic bag of marijuana to the teacher. The student admitted that he obtained the marijuana from a friend of his brother, Hughes.
The officer performed a security pat on the second student who smelled of marijuana and found another plastic bag of marijuana.
At this point the father of the students, McGillem, was called into the school. The officer spoke with the first student while his father was present. The student told the officer the same story he told the teacher, he obtained the marijuana from a friend of his brother. The student further advised that he smoked some of the marijuana out of a bowl and brought the rest to school. The student told the officer that there was a lot more marijuana at his house.
The officer then spoke with the second student with McGillem. The student advised that he had left the marijuana in his pocket while being searched to avoid getting into trouble. He further admitted that his brother’s friend had given him the marijuana.
According to the affidavit of probable cause, the two students and McGillem led the officer to their residence. As the officer approached the apartment, the door was open and a very strong odor of marijuana came from the open door. When questioned, McGillem admitted that he alerted Hughes through text message that they were on their way.
The officer received consent to search the residence and found Hughes and three friends, Kameron Banks, 18, Warsaw; Samantha Shepherd, 18, Goshen; and Keenan Creightney, 18, Warsaw, inside. Also found, were 63 empty plastic bags that were ripped open, 30 butane lighters, a grinder, a ceramic pipe, seeds and a homemade smoking device. Creightney had a bag of marijuana on his person. Hughes had a pipe that contained marijuana on his person.
The officer then obtained consent to search Hughes’ phone. On the phone were text messaged from McGillem including, “cops are on their way to the house to search it,” “get rid of everything” and “almost there with cop.”
All four teens were booked in the Kosciusko County Jail on March 17. Creightney was booked for possession of marijuana and aiding/induce/causing a misdemeanor, and Shepherd and Banks were booked for aiding/inducing/causing a misdemeanor.
McGillem was booked on March 24.
