Jury Now Up To 10 In Murder Trial
WARSAW — Four more jurors were seated following the second round of jury selection in the murder trial of Brandon T. Woody and Kyle D. DeHart, accused of murdering Tara Thornburg and Josh Knisley on Feb. 19, 2015.
The latest selection brings the juror count to 10, with two more jurors and three alternates yet to be seated. Thus far 26 potential jurors have been called.
Those who have been released from duty appear to be those who have indicated they have already formed an opinion and would find it hard to consider the evidence presented and who have pressing personal issues to keep them from serving — some due to health reasons, others being caregivers for adults and children or work issues. Several of those dismissed have noted emotionally detaching themselves, from what they have heard, the nature of the crime or knowing the victims, would be difficult; feeling they should not be in judgement of another; and not being able to change their opinion — guilty or not guilty — regardless of the evidence.
Thus far the jury is consisting of four men and six women.
The court broke for lunch at 1:10 p.m. to reconvene at 2:10 p.m. The third set of prospective jurors will include 14 individuals to take seats in the juror box, and 16 others in the audience seats.
The selection of the latest four took close to 90 minutes, less than the original six, even though the same questions were gone over by both the prosecution and counsels for the two defendants.
Woody and DeHart have been present in the courtroom during the jury selection, dressed in dress slacks and shirts and wearing ties. Two plain clothes jailers have also been in the courtroom, sitting in the audience section immediately behind each defendant.
The court, prosecution and defense have heard the majority of the 26 potential jurors indicate they have heard about the case in the media, but as shown following the voir dire, most have indicated they can disregard what they have read and heard and base his/her decision on the evidence presented.
