Woody Requesting Release, Probation Violation Admission Hearing Set
WARSAW — The court is taking no action on a letter filed by Brandon T. Woody asking for release on his own recognizance in relation to the murder charges against him.
The chronological case summary in this matter shows a letter sent by Woody to the court was filed May 10, requesting his release on his own recognizance. Kosciusko Circuit Court Judge Michael Reed had recorded the court would be taking no action on the correspondence as he is represented by an attorney. A letter from a family member of Tara Thornburg was filed with the courts June 9. The content of the letter was not disclosed.
The seven-day murder trial of Woody and co-defendant Kyle DeHart is still slated to begin at 8:30 a.m. Sept. 29, in circuit court.
Probation Violation Hearing Continued
On an unrelated matter, Woody appeared in Kosciusko Superior Court 1 Thursday, June 9, for an admission hearing on a probation violation charge from a 2010 case. The matter was continued to 8:30 a.m. Oct. 10.
Woody was sentenced April 5, 2010, after pleading guilty to charges of theft, dealing in marijuana and two counts of burglary. The charges were filed Nov. 24, 2009, after he was waived to adult court a month earlier. Woody was sentenced to two years in the Indiana Department of Corrections for theft and two years to the DOC for dealing in marijuana, both sentences to be served concurrently. He was also sentenced to eight years at the DOC on each theft charge, to run concurrently with one another, but consecutively to the first two charges. He was given a two-year suspended sentence to be served on probation.
According to the Indiana Department of Corrections offender website Woody was released on or about Nov. 14, 2012, to Kosciusko County authorities. Terms of probation were filed by the court Nov. 21, 2012, and the first verified petition for probation violation filed Sept. 4, 2013. He was released on bond Dec. 23, 2013, being ordered to appear Jan. 6, 2014, for a bond reduction. The bond reduction was granted with further hearings continued for various reasons. On Dec. 1, 2014, an amended verified petition of probation violation was filed. The bonding agency requested a hearing for revocation of bond Feb. 27, 2015, following his arrest on murder charges, this was granted. The probation department filed an additional amended verified petition of probation violation April 22, 2016.
He still is facing charges in a third case for burglary resulting in bodily injury and battery by means of a deadly weapon. This is set for a pretrial conference at 8:30 a.m. Oct. 10, the same time as his probation violation admission hearing.
