Defense Rests, Case Going To Jury
WARSAW — The case against Scott Wilkins, 27, 136 N. Main St., Milford, will be going to the jury late this morning, Thursday, Feb. 18. Wilkins has been incarcerated in the Kosciusko County Jail since his arrest on Jan. 2, 2015.
The fourth day of the trial began at 9:09 a.m. in Kosciusko Superior Court 3. The defense was to continue its case, however Mark Caruso, Wilkins’ attorney, stated after speaking with his client, he would not be testifying.
Wilkins told the court, his client has no memory of events and would not be testifying. The defense had nothing further to present.
Judge Joe Sutton recessed the trial at 9:13 a.m. instructing the prosecution and defense to meet in his office after a 10-15 minute break to go over final instructions for the jury.
Once the court reconvenes closing arguments will be heard from both sides and jury deliberations will begin.
Wilkins has been charged with causing a death when operating a motor vehicle with a schedule I or II controlled substance in the blood, a level 4 felony, failure to comply with acts required of a driver of a vehicle involved in an accident resulting in death, a level 5 felony, and reckless homicide, a level 5 felony.
