Elaine Fay Smith

WARSAW — Elaine F. Smith, 32, 322 N. 900E, Pierceton, was sentenced to 1 1/2 years in the Kosciusko County Jail on a charge of possession a schedule I controlled substance. One year will be suspended to be served on probation.

Smith’s submitted a plea agreement Sept. 14, however she entered a plea agreement, which the court took into consideration. The court accepted Smith’s plea of guilty to possession of a schedule I substance, which included dismissing charges of dealing in a schedule I controlled substance.

Her attorney, Christopher D. Kehler, also requested Smith be permitted to participate in the work release program if she qualifies. He also requested Smith be allowed to wait to report to the jail until Sunday, Oct. 18, as arrangements are being made for care of her 14-year-old dependent.
