DePuy Synthes Sued Over Patent Violation
A lawsuit filed Monday in U.S. District Court for Delaware claims a DePuy Synthes spinal implant “trespasses” on a Globus Medical patent.
Globus Medical is suing Johnson & Johnson for patent infringement, alleging DePuy Synthes’ Zero-P VA spinal implant violates U.S. patent #8,328,872.
Globus is seeking a jury trial, a judgment of infringement, a judgment of willful infringement (and the accompanying triple damages), injunctions barring further infringement, damages, interest and legal fees.
Audubon, Pa.-based Globus also wants the Delaware court to order Synthes to recall and destroy any devices found to infringe on the same ‘872 patent in the U.S.
