Man Sentenced For Selling Morphine Pills

WARSAW — A Warsaw man will serve the remainder of a six-year sentence locally after dealing morphine pills to an undercover officer.
Donald Alan Boseker, 59, Warsaw, was charged with dealing in a narcotic drug, a level 4 felony. A narcotic drug possession charge, as well as an additional narcotic drug dealing case, were dismissed as part of a plea agreement.
Boseker was sentenced in Kosciusko Circuit Court on Monday, Jan. 3.
On Dec. 3, 2019, an officer with the NET43 Drug Task Force made a controlled purchase of morphine pills, a narcotic drug, from Shawn R. Daniels, Boseker’s co-defendant.
According to court documents, the NET43 officer arrived at the established location and both Daniels and Boseker were at the scene. The officer provided Daniels with NET43 documented funds in exchange for five pills that were later confirmed to contain morphine.
An additional criminal case against both Boseker and Daniels was filed that same day after an Indiana State Police officer traveling on SR 13 in North Webster noticed a vehicle with an improperly functioning taillight. The officer pulled the vehicle over and identified the driver as Boseker and one of the passengers as Daniels.
While searching the vehicle, the officer found more than 11 grams of morphine pills in a container. Boseker was also in possession of the NET43 documented funds that were provided to Daniels during the controlled purchase of morphine.
After the traffic stop, Boseker admitted that he was selling the morphine pills that were found in the vehicle.
For this case, Daniels received a three-year prison sentence for dealing in a narcotic drug in September 2020. The entirety of the sentence was suspended on probation.
During court proceedings, Defense Attorney Scott Reust said Boseker has been a trustee in the Kosciusko County Jail for almost two years. He noted that Boseker was excited to transition to the county’s work release program.
For dealing in a narcotic drug, Kosciusko Circuit Court Judge Michael Reed sentenced Boseker to six years in the Kosciusko County Jail. Four years were ordered to be executed and two years were suspended on probation. Boseker already has 652 days, or roughly 1.7 years, of jail time credit in the case.
Judge Reed said he had no objection to Boseker serving the executed part of the sentence through the county’s work release or community corrections programs.
Prior to the sentencing’s conclusion, Reust and Boseker asked if it would be possible for Boseker to serve the rest of his remaining sentence entirely through the county’s work release program. Reust said this was due to Boseker wanting to move and change his environment to further avoid drug use. Judge Reed said sentence modification could be considered in the future.
