Pregnant Woman Files Lawsuit Against Time Out Inn
WARSAW — A pregnant woman is suing the Time Out Inn in Warsaw after allegedly being physically attacked and assaulted on the premises.
The plaintiffs in the case are Ashley Riggs and her unborn child.
According to the court filing, on or about Sept. 2, 2018, Time Out Inn employed security staff who were assigned to work on the premises. During the course of the evening, Riggs was physically attacked and assaulted at the Time Out by multiple patrons. The lawsuit states that security staff at the Time Out knew of the attack and did nothing to prevent, stop or mitigate the attack.
The case, filed Feb. 25, 2019, states the Time Out “had a duty to properly train and supervise its employees, including its bouncers, so as to prevent harm from occurring to invitees on its premises. The Time Out breached that duty by failing to adequately and properly train and/or supervise its bouncers and other employees.”
As a result of the assault, Riggs “suffered bodily injury including a permanent injury to the body as a whole, pain and suffering, physical impairment, disfigurement, mental anguish, inconvenience, loss of capacity for the enjoyment of life, expense of hospitalization, medical and nursing care and treatment, loss of earnings, loss of ability to earn money and loss of ability to lead and enjoy a normal life.”
Riggs’ unborn child may be injured but as of yet, any such injury is unknown as of the filing of this suit. Riggs is demanding a trial by jury for the case.
