KOSCIUSKO — A Claypool man was arrested after failing to pull his vehicle over for a police commission with its lights and siren on and speeding in excess of 100 miles per hour.
Joshua Gordon England, 34, 2654 E. CR 700S, Claypool, is being charged with resisting law enforcement, a level 6 felony; reckless driving, a class C misdemeanor; and possession of paraphernalia, a class B misdemeanor.
On Jan. 4, an officer with the Kosciusko County Sheriff’s Office observed a vehicle traveling southbound on CR 650E with a passenger-side headlight not illuminated.
The officer began heading southbound on CR 650E with the intention of conducting a traffic stop on the vehicle.
According to the affidavit of probable cause, as the officer attempted to catch up with the vehicle, the officer accelerated to a speed in excess of 100 miles per hour and was still unable to gain ground on the vehicle.
The vehicle then turned east onto Old Road 30 and the officer continued to follow the vehicle with his commission’s lights and siren activated. The vehicle then turned south onto SR 13. While southbound on SR 13, the officer’s vehicle was approximately 400 feet behind the vehicle with its lights and sirens activated and the vehicle failed to stop, reaching a speed of 120 miles per hour.
The vehicle then entered the parking lot of a Speedway station and stopped in a parking spot. The officer then exited his vehicle and ordered the driver of the vehicle to exit with his hands up. The driver of the vehicle, later identified as England, exited the vehicle as ordered.
The officer spoke with England, who advised he saw the police lights behind him and knew he should have pulled over sooner but that he was nervous and wanted to get home. A K9 unit performed an outer air search of the vehicle and made a positive alert.
The officers discovered a small glass smoking device containing burnt marijuana residue in the vehicle.
England has already been arrested and released on his own recognizance. He has an initial hearing date at 2:30 p.m. Friday, Jan. 25, in Kosciusko Superior III Court.
