Warsaw Man Receives 20 Year Sentence, Ordered To Serve 12
WARSAW — A Warsaw man received a lengthy sentence in Kosciusko Superior Court 2 on Tuesday, Jan. 15; however, he will be allowed to serve that time through the Kosciusko County Community Corrections program, providing he is accepted.
Nathan Scott Dimmock, 32, who gave the court an updated address of 1920 S. Old SR 15, Warsaw, pleaded guilty to charges in three separate cases. In case F894, Dimmock pleaded guilty to burglary, a level 4 felony; in case F371, he pleaded guilty to burglary, a level 5 felony; and in case F646, he pleaded guilty to theft (enhanced), a level 5 felony.
On Sept. 20, 2018, a female subject contacted the Warsaw Police Department regarding subjects inside her residence wearing masks. When an officer arrived at the residence, he observed two masked individuals inside. One subject fled out the back door but was apprehended by the officer.
Officers used a K9 unit to track the second person, identified as Dimmock. The officers found a backpack outside the residence that contained stolen items from inside the residence. Dimmock and the other male entered the residence by breaking a window and kicking the garage door open.
In court today, Dimmock’s attorney, John D. Barrett, stated that Dimmock has accepted responsibility and expressed remorse for his actions, and requested that Dimmock be allowed to serve his sentence through Community Corrections. Barrett stated that Dimmock has already been tentatively accepted into that program.
Judge Torrey Bauer pointed out that after serving a previous sentence at the Indiana Department of Corrections, Dimmock was released on April 1, 2017. On April 30, 2017, Dimmock allegedly committed another crime.
“Not even one month after your release from IDOC,” said Bauer. “I wouldn’t think you’d want to go back to IDOC, but maybe you do — maybe you enjoyed it there.”
Bauer stated that if approval were to be given for Dimmock’s sentence to be served through Community Corrections, any violation would result in Dimmock being sent to IDOC to serve out the remainder of his sentence. Bauer then cautioned Dimmock not to waste everyone’s time if he was simply going to end up back at IDOC.
“You can go back to IDOC now and hang out with your homies if that’s what you want,” said Bauer.
After Dimmock insisted he did not wish to return to IDOC and asked for a chance to prove himself through Community Corrections, Bauer sentenced Dimmock to 12 years executed at the IDOC for the level 4 burglary charge, but stated he had no objection to the sentence being served through Kosciusko Community Corrections provided Dimmock is accepted there. Dimmock was given 117 days of jail time credit in that case. He was ordered to pay $358.18 in restitution as well as court fees.
For the level 5 burglary charge, Dimmock was sentenced to six years at the IDOC, with the sentence ordered to be suspended and served on probation. He received 11 days of jail time credit. This sentence was ordered to be served consecutive to the previous sentence.
Dimmock was sentenced to two years in the IDOC for the level 5 theft charge, with the sentence ordered to be suspended and served on probation. He was given 230 days of jail time credit. This sentence was ordered to be served consecutive to the other two sentences.
Pursuant to the plea agreement, another case was dismissed.
