Warsaw Man Faces His Third Battery Arrest Against Same Victim
WARSAW — A Warsaw man is facing felony charges after battering a female victim who he has been convicted of battering twice before.
Billy Joe Truex, 34, 504 W. Center St., Warsaw, is being charged with domestic battery with a child present, a level 6 felony; domestic battery, a class A misdemeanor; and domestic battery with a sentence enhancement, a level 5 felony.
On April 1, officers spoke with a female victim about an incident that started on March 30. The victim advised that Truex was arguing with her about not paying attention to him. Truex continued to argue with her and accused her of things she had not done.
According to the victim, Truex continued to accuse her of things and argue with her on April 1. When the victim refused to give him her phone, he grabbed her by the neck, shoved her into the closet and threw her on the bed. A minor child was lying on the bed and began to cry at this point.
The affidavit of probable cause goes on to state that Truex grabbed the victim again, threw her to the floor, pinned her down and took away her phone. The victim told the minor child to use his phone to call 911, and Truex also grabbed that phone. The child began crying again and Truex “begged” the victim to not call the police.
The victim was able to get outside, but Truex threw her up against the apartment building, causing vehicles to stop on Center Street.
Truex was previously convicted of two domestic battery cases in Kosciusko County Court against the same victim.
Truex was booked into the Kosciusko County Jail on May 10, with a $21,750 surety and cash bond.
