Three Face Felonies After Brothers Get In Fight With Stepfather
WARSAW — Three people are facing felony charges after officers responded to a fight between two brothers and their stepfather. The stepfather suffered from two broken ribs, a punctured lung and lacerations to his head.
Zachary Deven Schultz, 22, 407 S. Indiana St., Warsaw, was arrested on April 29, and faces charges of domestic battery causing serious bodily injury, a level 5 felony, and domestic battery, a class A misdemeanor. Tyler Schultz, 18, 407 S. Indiana St,. Warsaw, has a warrant out for his arrest for the same charges.
The stepfather Tristan Bailey, 34, 407 S. Indiana St., Warsaw, also has a warrant out for his arrest for two counts of domestic battery resulting in serious bodily injury, level 5 felonies, and two counts of domestic battery, class A misdemeanors.
On March 29, an officer with the Warsaw Police Department responded to the Indiana Street residence for a battery in progress. Zachary, Tyler and their stepfather Bailey were all at the residence.
The officer observed that Zachary was bleeding from a large laceration on his jaw. Zachary was transported to Lutheran Hospital in Fort Wayne for his injuries. The officer also observed that Tyler had cuts on his hand and a bump on the back of his head.
Bailey told the officer that he had gotten into an argument with his stepsons and they both began punching and kicking him, causing him to fall to the floor. According to Bailey, the sons continued to hit him until the officers arrived.
Tyler admitted to punching and kicking Bailey. He further stated that he and Zachary “beat the s***” out of Bailey. Zachary admitted to hitting Bailey and slamming him into a vehicle.
Bailey was treated for his injuries at Lutheran Hospital in Fort Wayne. According to the affidavit of probable cause, he suffered from two broken ribs, a punctured lung and lacerations to his head.
It was noted that Bailey was convicted of domestic battery, a class D felony, in 2008.
