MILFORD — A former Milford resident was released on time served after being sentenced for having sex with a pony on several occasions.
Phillip Butler, Wawaka, was sentenced on amended charges of criminal trespass, a class A misdemeanor and attempted bestiality, a level 6 felony.
A complaint was filed with the Kosciusko County Sheriff’s Department in April 2017 in regards to someone having sex with a pony. The witness stated that he observed Butler’s truck parked near the barn on April 19. When the witness entered the barn, he observed Butler standing behind a female pony named Duchess. Butler’s pants were down and he was having sexual intercourse with the animal. When the witness confronted Butler, he stated he has a problem and wouldn’t do it again.
According to the affidavit of probable cause, the witness has caught Butler having intercourse with a pony on several occasions. The witness’s wife and daughter have also caught Butler having sexual intercourse with ponies. The witness was able to capture photographs of the indecent acts by setting up a motion sensing camera.
An officer with the Kosciusko County Sheriff’s Department spoke with Butler. He admitted to the officer that he was not allowed on the property and further stated that he did have sex with the pony. Butler also revealed that he takes the pony to the back shed so no one can see him.
Judge Joe Sutton sentenced Butler to serve six months for criminal trespass and one year for attempted bestiality. All but six months of this term was suspended to be served on formal probation and Butler was released on time served.
As a special term of probation, Butler is to have no contact with any horses during the period of his sentence.
