Sex Offender Arrested For Failing To Report Address Change
KOSCIUSKO COUNTY — A Warsaw man who was ordered to register as a sex offender for life and is considered a sexually violent predator, has been arrested after he failed to report a change of address in 2015.
Abraham Garcia, 37, whose court document shows an address of 240 E. Levi Lee Road Lot 141, Warsaw, but was booked with an address of 1214 Mason St., Elkhart, was arrested Tuesday evening, Jan. 16. He has been charged with failure to register under the sex offender statute, a level 6 felony, with an enhancement to a level 5 felony.
He is being held on $15,250 surety and cash bond.
The affidavit of probable cause, filed July 17, 2015, states Aug. 23, 2007, Garcia was convicted of child molesting in Kosciusko County Circuit Court and was ordered to register as a sex offender for life and is a sexually violent predator. On July 15, 2011, he pleaded guilty to failure to register as a sex offender in Elkhart County Superior Court IV.
Documents report Sept. 10, 2014, he did register at the Kosciusko County Sheriff’s Department and provided an address. On Nov. 28, 2014, he reported a change of address to the Levi Lee Road address and provided his place of employment.
On March 10, 2015, he advised officials with the sheriff’s department he was moving to a location in Elkhart County and authorities there were notified. An officer with Elkhart County went to the address he provided and spoke to the resident at that location who stated Garcia had never lived at that address.
A Kosciusko County sheriff’s deputy then went to the Levi Lee Road address and spoke with the current resident, learning Garcia had not lived at that address for three months. Police also learned Garcia had not been employed at an area business since December 2014.
Authorities had been unable to locate Garcia to determine a residence or place of employment until recently.
