Jury Rules In Favor Of Zimmer Biomet In Pennsylvania Civil Case
PHILADELPHIA, PA. — A federal jury entered a verdict in favor of Zimmer Biomet, Warsaw, and against the plaintiff Dominick Pistone “as the plaintiff’s claims and as to defendant’s counterclaims.” Zimmer Biomet was awarded a judgement of $125,000. The case was heard before the U.S. District Court Eastern District of Pennsylvania.
Pistone sued the Warsaw orthopedic company for $15 million for wrongful and retaliatory termination.
The civil jury trial began Sept. 11 in Philadelphia with the selection of an eight-member jury. The trial continued for nine days before it was given to the jury. A verdict was entered Sept. 22. A settlement conference has been set for Nov. 3 with Magistrate Judge Marilyn Hefley.
The lawsuit was filed June 27, 2016, against his former employer after his termination following testimony before a Northampton grand jury in connection with what he believed to be the patient misconduct of an orthopedic surgeon in Allentown, Pa., and the medical practice with which that doctor is affiliated.
