Nathan N. York, 3762 West Old Road 30, Warsaw, is also being charged with count I theft, class A misdemeanor, and count IA sentence enhancement theft, a level 6 felony.
According to the affidavit of probable cause, on Friday, Nov. 11, an officer responded to a theft complaint at Walmart, 2501 Walton Boulevard, Warsaw. A Walmart loss prevention employee told the officer she had seen two male subjects, later identified as Tackett and York, using a self-service register. The employee saw the two males failing to scan some items before bagging them.
When they finished bagging the merchandise, Tackett and York proceeded to leave the store. The loss prevention employee stopped them, identified herself and asked them to come to the loss prevention office with her.
According to the receipt provided by the employee, Tackett and York attempted to steal three burritos, a package of cheese, two subs, a bottle of ketchup, a bottle of Jack Daniel’s sauce, a bottle of mustard and a bottle of A1 steak sauce. The total value of the items was $34.17.
Since the men had both previously been convicted of theft, the charges were enhanced to felonies.
Tackett and York were booked in the Kosciusko County Jail on Nov. 11, on bonds of $5,250 surety and cash.
