No Progress for Pierceton Water Ordinance
PIERCETON — The Pierceton Town Council met for a brief meeting Monday, Sept. 12.
The council is currently in discussion on a new ordinance which will be changing how water utilities are handled for rental properties. The new ordinance will put the responsibility of water and sewage payments onto the property owner and not the tenant. Tabled at last month’s meeting after a heated debate, no motions were made this month due to council member Mandy Espinoza’s absence.
President Tom Barker did open up the floor for new comments on the matter. A present property owner who had talked to an attorney brought forward information regarding potential legal issues with the new ordinance, specifically that landlords may be facing lawsuits if they were to shut off their tenant’s water in cases of unpaid rent.
“You cannot force evict people. You can not turn utilities off to force them out.”
Barker and Treasurer Jerry Kreger stated that several other landlords have inquired about the ordinance but none have complained. It was suggested that the council send landlords notices of the change out of courtesy.
With no new comments, the discussion was closed and the business tabled until next meeting.
In other business:
- EMS captain Alicia Elder presented the monthly Fire/Rescue report.
- There will be an Open House, 5 p.m. to 8 p.m. Friday, Oct. 14, at the Pierceton Fire Station. In case of rain the event will be held in the community room.
