Warsaw Man Sentenced On Charges Of Battery And Intimdation
WARSAW — Kyle J. Brooke, 1205 Wooster Road, Winona Lake, through a plea agreement, was sentenced to a total of eight years to be served at the Indiana Correctional Facility on counts of battery by means of a deadly weapon, intimidation and habitual offender. One count of burglary was dismissed. Brooke must pay a $100 fine. Brooke will receive 404 days of credit from time already spent in jail.
At the sentencing, many people attended to show support to Brooke. Sue Krueger, a friend of Brooke’s, spoke on behalf of Brooke, “I think this incident was not his true character.”
Brooke also spoke, requesting for the judge to be gracious with him as Brooke admitted he had an addiction but wanted to return home to take care of his daughter. “I’m not asking or pity, sympathy or a slap on the wrist, I’m asking for a chance.”
“I don’t want to take you away from your daughter, but you took yourself away from your daughter,” stated Judge Reed.
The affidavit of probable cause states police received information on July 29, that an individual had been severely beaten by Brooke and his girlfriend, Heather May. Police spoke with victim the following day observing a face that was severely bruised and a cut on his left hand.
The victim reported on July 21, 2015 he was at his home when he heard someone beating on the door. May walked into the home uninvited and began yelling and screaming at him wanting to know the location of two individuals, who she claimed were “snitches.”
He also told police Brooke came into his home, uninvited, and asked for the same individuals. The victim stated Brooke placed a large folding knife to his neck, again asking where the two individuals were.
The victim was able to grab Brooke’s hand and tried to push it away from his throat to keep from getting cut, but instead cut his hand. Brooke then reportedly head butted the victim in the face, beat him and threatened him while May was yelling at him.
Brooke reportedly moved the knife to the victim’s stomach and groin area while threatening him.
When May received a text message, she told Brooke they need to leave because the victim did not know anything. Brooke threatened to kill the victim, gave him 24 hours to leave town. He moved out of his residence at that time fearful Brooke would find him.
