Favorable Recommendation Given To Vacate Street
WARSAW — A request to vacate an undeveloped street received a favorable recommendation by the Warsaw Planning Commission. That favorable recommendation will now send the request to the city common council for final action. The unanimous decision was made in a brief meeting Monday evening, May 9.
Attorney Richard Helm, on behalf of Harvey and Lilly Hayes, owners of property at 977 N. Lake St., and 986 N. Lake St., came before the commission to request the vacation. The street is located between the two properties and is plated from Lake Street to Warren Street. Helm noted two adjacent property owners: Thomas and Sandra Groninger and Zimmer Holdings Inc., at the west edge, had no objections.
James Emans, city engineer, requested the city maintain the sanitary sewer easement in the western boundary. Helm stated while he was not aware of there being a sanitary sewer line, the state statute does allow for that easement to remain, regardless if vacated or not. Helm stated he would amend the proposed ordinance regarding the easement.
Jeremy Skinner, city planner, noted there was no issue from the city’s standpoint, other than the easement.
