Man Arrested For Rape, Sexual Battery
Noah Emmanuel Akins, 24, 201 N. First St., North Manchester, was arrested Sunday on charges of rape.
Charges were filed Monday in Kosciusko County Superior Court 1 charging Akins with rape, a level 3 felony and sexual battery, a level 6 felony. A level 3 felony carries a penalty upon conviction of a fixed term between three and 20 years in prison. A level six felony carries a fixed term between six months and 2 1/2 years.
The affidavit of probable cause states on May 10, Kosciusko County Sheriff’s Officer Thomas Waikel responded to a sexual assault call. He spoke with a female who stated a family member brought Akins to their residence after a night of drinking.
The female fell asleep in bed with her husband when she woke to someone having oral sex with her. When she realized it was not her husband, she began kicking the person realizing it was Akins. She began yelling and telling him to get out and he crouched beside the bed. She continued yelling at him before he left the room.
Police were also told by the victim, he posted an apology ” … I am so sorry, between my divorce, liquor and what we used to have, I made a huge mistake, it will never happen again.”
Akins told police he went into the bedroom to tell her, the family member’s vehicle was still parked at his residence. He grabbed the female’s leg, shook it and she started kicking, kicking him in the head. He stated he only touched her leg that he knew of, but may have touched her someplace else. Police did see a bump on his forehead.
Akins is being held on $30,000 surety bond.
