Higgins Petition Approved With Conditions
Among the petitions considered by the Kosciusko County Board of Zoning Appeals during its regular monthly meeting Tuesday in Warsaw was a planned unit development (storage facilities) for Patrick Higgins. The property is zoned agricultural and is on the west side of Chapman Lake Drive, north of Greystone Drive in Plain Township.
Higgins was granted approval with the conditions private restrictions be integrated including no business operations on the property, a clear definition of what constitutes junk and a 10 foot setback for any outside storage.
Other agenda items included:
• Richard Yoder was granted an exception to allow an existing 15 x 18 room addition to remain on a tract with two residences without a permit or hearing, on property located on CR 450S, west of Country Club Road in Clay Township.
• Donald and Theresa Gunden were granted a variance to permit the construction of a grade level patio with deck above 26 feet from the water’s edge when the ordinance requires 35 feet, on property located on Northshore Drive, west of Eastshore Drive in Turkey Creek Township.
• Jeff and Sherri Southworth were granted an exception to allow an overhang on property on the west side of EMS B27 Lane in Tippecanoe Township.
• Nicholas Denney was granted an exception to allow a home based business, in this case deer processing on South Jefferson Street in Silver Lake.
• Janet Freel was granted a variance to permit temporarily allowing two residences on one tract for one year during remodeling of an existing residence on CR 750S, west of CR 700E in Monroe Township, but she must have the mobile home removed within 18 months.
• Jarrett LLP was approved for a variance to permit the construction of a second residence on one tract, a carriage house, on Pickwick Drive, northeast of Island Avenue in Turkey Creek Township. As a condition of approval, there must be a statement on the face of the deed saying the carriage house will not be rented to a separate party.
• Charles and Kathleen Oleson were granted an exception for the purpose of construction of a boathouse on a tract without a residence zero feet from the water’s edge and 5 feet from the side line on Forest Drive, north of Walnut Drive in Turkey Creek Township.
• David Garl was granted an exception to change and alter a non-conforming property, in this case a garage crossing property lines that was built before the zoning ordinances were in place, on EMS B60 Lane, southeast of EMS B61 Lane in Tippecanoe Township. Garl wants to rebuild and improve a porch.
• Mark Dumlija was granted an exception to allow a non-conforming and illegally placed and enlarged sign to remain without a permit closer than the ordinance allows on the west side of SR 13 at the intersection with CR 700E in Turkey Creek Township.
BZA officers for 2015 were elected: Lee Harman, chairman; Walt Church, vice chairman; and Ben Plikerd, secretary.
