Initially arrested for rape, a B felony charge of sexual misconduct with a minor has been filed against Juan Ramon Juarez, 21, of Warsaw.
A probable cause affidavit filed in the case indicates that a Kosciusko County Sheriff’s Deputy was called to Green Acres Mobile Home Park on Monday to investigate a battery and possible rape. Officer James Smith located the alleged victim, a 14-year-old girl, who was outside in the grass crying.
According to information filed with the prosecuting attorney’s office, the girl’s brother told his parents the girl was “being hurt” in a bathroom at Lot 15 by Juarez. The girl’s father and another male subject went to Juarez’s trailer and found the bathroom door locked. Juarez yelled, “Everything is okay in here,” but the men broke down the door and found the two engaged in intercourse.
Juarez admitted to the officer that he did have sex with the girl and was immediately taken into custody. The girl was interviewed by Michelle Dutton from the Sexual Assault Treatment Center in Fort Wayne and said she consented to having sex with Juarez, but that she did tell him she was only 14 years old.
Juarez was booked in the Kosciusko County Jail on a $10,000 surety bond.
